Duty on a 25yr old import

I have been told that duty never goes away on importing into Canada and I have been told that a car over 25yrs is exempt.

Can anyone verify which is correct.

You can bring in any* car that's over 25 years old.

It is not exempt from duty. Nothing is exempt from duty except things that fall under special trade agreements (like NAFTA).

Where did you get that number from? I thought it was 15 years old? Does the 15 year old rule apply for American cars only and 25 year old rule for worldwide cars?

^^sorry, may be 15, i'm not sure. AFAIK its 15 from USA and 25 for everywhere else, but i'm not certain.

I see some gray import cars here sometimes.

Last week I saw what looks like a 1995-1999 Alfa Romeo Spider downtown, I couldnt believe my eyes... There is a guy with a Fiat 126 that lives in my area too.

over 25 years you can import anything. There are loopholes to bring other stuff in though.

Cars from USA - year doesn't matter as long as it's not on the restricted list.
Cars over 15 years old, you can bring any passenger car from anywhere. (except you can not register RHD cars in Quebec)

25 year old rule is in USA.

15 yrs exempts you from RIV fees , and it was local BMW dealer that told me no duty from the US on a 25 yr old vehicle. I am not trying to question peoples help on this thread ...just want to get the facts , as it might mean the difference between buying a classic or not. thanks

That's not true, you still pay 110$ RIV fee (for form 1) even on 15 year old vehicles. You're just exempt from the inspection.

You do NOT have to pay duty when importing a car older than 25 years old.

The correct tariff classification is 9966.00.00.

I recently imported a car more than 25 years old and was charged duty at the border and I did not question it at the time. I was alerted to the misclassification by a neighbour who also recently imported a car older than 25 years old and did not pay duty. I since found advice on this board:

I have applied for the refund but have not received it yet.

Note also that PARTS imported for use on a car older than 25 years are exempt from duty too.

You absolutely do not have to pay the RIV fee on a car 15yrs or older. They will gladly take your money though if you decide to give it to them.

You need the Form 1 to import a car more than 15 years old, but as the car is exempt from the RIV program there is no fee.

I'm looking at my form now: Section 16 gets filled in and stamped for exempt vehicles. Section 17 gets filled in when you need to enter the program and that's when the fee is required.

I'll look at my paperwork from when i imported my last car. I'm almost positive i paid 100 (or 110$) RIV fee, 100$ AC tax, 6.1% duty and 5% gst. You seem to know your stuff though, so i'm not gonna argue with you
